3. offer and conclusion of contract
3.1 The presentation of the products in the online shop does not represent a legally binding offer, but an invitation to order. All offers are valid "while stocks last", unless otherwise stated with the products. Errors excepted.
3.2 By clicking on the button "Complete order" in the last step of the ordering process, you place a binding order for the goods contained in the shopping basket. The purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.

5. instruction about the legal right of withdrawal
5.1 You have the right to withdraw from a contract concluded with us (the purchase of goods via our online shop herrmanns-manufaktur.com) within 14 days without giving reasons.
The withdrawal period is 14 days
from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods;
in the case of a contract for several goods which you have ordered as part of a single order and which are delivered separately, from the day on which you or a third party named by you who is not the carrier has taken possession of the last goods; or
in the case of a contract for the delivery of goods in several partial consignments or pieces, from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last partial consignment or the last piece.
5.2 To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). You can use the model withdrawal form for this purpose, which is, however, not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
5.3 Consequences of withdrawal: If you withdraw from a contract concluded with us, we must reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received the notification of your withdrawal from the contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. We will not charge you any fee for the repayment.
5.4 We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
5.5 You must return or hand over the goods to us without delay and in any case no later than 14 days from the day on which you notify us of your withdrawal from the contract. The deadline shall be deemed to have been met if you send off the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.
5.6 You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the condition, properties and functioning of the goods.
5.7 Exceptions to the right of withdrawal: You do not have the right to withdraw from contracts concerning
Goods that are manufactured according to customer specifications or are clearly tailored to personal needs;
Goods that can spoil quickly or whose expiry date would be quickly exceeded;
Goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery;
Goods which, due to their nature, have been inseparably mixed with other goods after delivery;
Exchange
Apart from the legal right of withdrawal (point 6.), the exchange of goods that are free of defects and have been sent correctly in terms of type and scope is excluded.

6. prices and shipping costs
6.1 The prices stated on the product pages include the statutory value added tax and other price components.
6.2 The shipping costs depend on the quantity of goods ordered as well as the shipping method and will be clearly communicated to you before you place your binding order.
7. delivery
7.1 Delivery shall only take place within Germany. On request we also deliver abroad.
7.2 The delivery time is, insofar as the goods are available, 2 to 4 working days. We point out possible deviating delivery times on the respective product page.
7.3 If the ordered product cannot be delivered on time because we are not supplied with this product by our supplier on time, we will inform you immediately. In such a case you are free to wait for the ordered product or to cancel your order. In the event of cancellation, any consideration already paid will be refunded immediately.
8. payment
8.1 Payment can be made either by advance payment, PayPal (credit card) or by direct debit.
8.2 If you choose the prepayment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.
8.3 You are only entitled to offsetting if your counterclaims have been legally established by a court or acknowledged by us in writing.
8.4 You may only exercise a right of retention if the claims result from the same contractual relationship.
9. reservation of title
The goods remain our property until full payment has been made.
10. warranty
The warranty is provided in accordance with the statutory provisions.
